“2024 Ultimate Ears You, Me and HAWAII” PROMOTION

TERMS AND CONDITIONS

1. Information on how to enter and the prize(s) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2. The Promoter is Logitech Australia Computer Peripherals Pty Ltd (“Logitech”) of 72/4D Huntley St, Alexandria NSW 2015

3. Entry is only open to New Zealand and Australia residents aged 18 years or over.

4. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

5. Entries into the promotion open at 12:00 am NZST / 12.00 am AST on 10/10/2024 and close at 11:59pm NZST / 11.59pm AST on 10/01/2025 (“Promotional Period”).

6. To be eligible to enter, individuals must purchase a ‘Ultimate Ears speaker’ product from any offline or online retailer in New Zealand or Australia authorised to sell Ultimate Ears products during the Promotional Period. For the sake of clarity, this includes the Logitech New Zealand and Australia e-shop.

7. To enter, individuals must:

• During the Promotional Period, visit https://www.ultimateearsdeals.com/au/hawaii-comp/ for Australia, or https://www.ultimateearsdeals.com/nz/hawaii-comp/ for New Zealand competition pages, then follow the prompts to the promotion entry page, input the requested details (first name, last name, address, mobile number, email address) including the details of the product purchased, the place of purchase and upload an image of the receipt.
• Then, state in 25 words or less WHY they wish to travel to Hawaii.
• After that, submit the fully completed entry form during the Promotional Period.

8. The winners will be judged by Logitech employees based on the creativity of the written response to the question regarding the entrant’s reason for wanting to win the trip to Hawaii.

9. Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per transaction; and (b) each entry must be submitted separately and in accordance with entry requirements.

10. Entrants must retain their original purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the store of purchase (including Logitech New Zealand or Australia e-shop) and that the purchase was made during the Promotional Period but prior to entry.

11. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

12. Incomplete or indecipherable entries will be deemed invalid.

13. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

14. Judging will be based on creativity of answers submitted as follows:

14.A Weekly game based on creativity.

The weekly judging sections will be commencing on 18/10/2024 at 12:00 pm AST till 10/01/2025 at Promoter’s registered office at Australia Computer Peripherals Pty Ltd, 72/4D Huntley St, Alexandria NSW 2015. The Promoter may judge additional reserve entries and record them in order in case of an invalid entry or ineligible entrant. The weekly prizes (“Weekly Prizes”) to be won are listed and specified in the table in Clause 16 below.

i. How to Enter the Weekly Game:

Submit a 25-word or less response to the question: “Tell us why you want to go to Hawaii”.

ii. Weekly Prizes awarding mechanism:

Answers received from individuals will be judged on a weekly basis as specified in the table under Clause 16 below. Six (6) winners from Australia and six (6) winners from New Zealand will be selected as follows:

• 1 Logitech product will be awarded to the most creative answer in Australia and New Zealand respectively for that week (“Weekly Most Creative Winner”).
• 5 digital Casetify vouchers (valued at either AUD100 or NZD100) will be awarded to the other 5 winners as “Weekly Five Runners-up for Creativity” in Australia and New Zealand for that week respectively. The use of the digital Casetify vouchers is subject to Casetify’s Terms and Conditions. The digital Casetify vouchers shall be valid from 18 October 2024 AEST/NZST 9:00:00 until 31 Jan 2025 AST /NZST 23:59:59.

iii. Important Information:

• Entrants who submitted their entries within the specified time frame will be eligible for judging for that particular week only.
• Only the Weekly Most Creative Winners will be eligible for the the Grand Prize (as defined below);
• The Weekly Five Runners-up for Creativity for each week and other entrants will be excluded from the Grand Prize.

14.B. The trip to Hawaii as the grand prize (the “Grand Prize”) .

i. Grand Prize judging and awarding:

• Only Weekly Most Creative Winners are eligible to be further judged and awarded the Grand Prize.
• The judging of the Grand Prize will take place on 27/01/25 at 12:00pm NZST/ 10.00am AST at Promoter’s registered office at Australia Computer Peripherals Pty Ltd, 72/4D Huntley St, Alexandria NSW 2015.

15. The Promoter’s decision is final and no correspondence will be entered into.

The Weekly Prize winners will be notified by email and/or by phone call within seven (7) business days of the relevant judging.

The Weekly Most Creative Winners will receive their prizes by mail.

The Weekly Five Runners-up for Creativity will receive their prizes by email.

16.B. The judging date and value of the Grand Prize to be won is listed in the table below.

17. For sake of clarity, the Grand Prize includes a Flight Center voucher of AUD10,000 or NZD10,950, which can be used for accommodation in Hawaii, flights between New Zealand or Australia and Hawaii. The winner may include additional traveller(s) as long as the total package value does not exceed AUD10,000 or NZD10,950. Logitech reserves the right to determine what eligible expenses are, and certain bookings may need to be made via Logitech.

Point of departure will be in the nearest city of the place of residency of the winner either in New Zealand or Australia.

Spending money, meals, taxes (excluding airline and airport taxes), insurance, passports, visas, vaccinations, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included.

Travel is valid for 12 months from when the Grand Prize is awarded and is subject to booking and flight availability. All bookings must be made a minimum of 90 days in advance of requested departure dates.

18. In the event of war, terrorism, state of emergency, pandemic or any other kind of disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend, substitute or modify the prize, subject to any written directions from a relevant regulatory authority.

19. Subject to the unclaimed prize clause, if for any reason a winner does not take a prize (or an element of the prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.

20. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

21. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.

22. An alternative judging based on creativity of the answer for the Grand Prize in the event of unclaimed prize may take place on 10 February 2025 at the same time and place as the original judging, subject to any directions from a regulatory authority. The alternative winner, if any, will be notified by email and/or phone call within seven (7) business days of the judging. Any unclaimed Weekly Prizes will be forfeited.

23. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

24. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

25. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

26. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under any statutory consumer guarantees as provided under consumer protection laws in Australia and/or New Zealand (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

27. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.

28. As a condition of accepting a prize, the winner (and their companion where relevant) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

29. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://www.logitech.com/en-au/legal/web-privacy-policy.html. All entries become the property of the Promoter.

30. The laws of Australia apply to this promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the competent courts of Australia.
